General
The following Terms and Conditions shall apply to the business relationship between the domain and sub-domains of www.ehaggler.co.uk (hereinafter: "Ehaggler") and our users. By using Ehaggler the user accepts the following Terms and Conditions, as well as the manner in which Ehaggler operates as described on our website. Any variations or alterations in the following Terms and Conditions shall only be binding if agreed to in writing. We recommend reading through all of the Terms and Conditions before participating in any of our auctions.
Bidding advice, articles or other information posted on our website, such as under the "How it works" section, are only suggestions, and are not to be relied upon. Ehaggler shall not be liable or responsible for any action taken by a user on our website or the action of any other person who may have read or been informed of any such information or other written material.
The original text of the Terms of Use is in English and any current or future interpretation of them will be based on the original English text. If the Terms of Use or any documents or notices related to them are translated into any other language, the original English version will always prevail.
Changes to Terms
We reserve the right to change these Terms including for legal, regulatory or security reasons at any time. Whilst we may post changes on the Website or send emails in relation to major changes, it is the users’ responsibility to check the Terms for changes that may affect them. If you do not agree to any Terms then you can simply stop using the Services and Website at any time. Eligibility
In order to participate at Ehaggler, you must be at least 18 years of age. Ehaggler employees and their family members are eligible to participate but only once they have received written authority from the company and they understand that no preferential allocation of bids will be allocated to them.
Registration
Ehaggler reserves the right to limit the number of users per household. Users may not provide deceptive information. Accounts are non-transferable.
When selecting a user name, the user is subject to choosing a name that is not in any way offensive, indecent or derogatory. Additionally, a user may not select a user name that is misleading or advertises other websites. Ehaggler reserves the right to change or delete user accounts that are violating these conditions. It is solely the responsibility of the user to ensure that their password is kept confidential. In most cases, the user shall be liable for all activities that are undertaken using their account. Any misuse of the account may result in the user subsequently being banned from participation on Ehaggler.
You may cancel your account at any time by sending an email to info@ehaggler.co.uk.
Referrals
You may refer friends to the Website using the form on the Website which is within the user’s ‘My Account’ section. We offer free Bids to any user who refers new users that purchase a Bid Pack. We reserve the right to review each referral for possible fraud. You may not refer family members located in the same household. Any abuse of the referral system will result in the deduction of fraudulent bids awarded and/or the termination of the user's account.
User conduct
The user agree that in using the Website the user will not: (i) use the Website for any unlawful purpose; (ii) access or attempt to access the accounts of other users or to penetrate or attempt to penetrate the Website security measures; (iii) use unauthorised third-party bidding or bid tracking software; (iv) create multiple accounts; (v) collude with other users to influence the outcome of auctions or (vi) use the Website for any other purpose other than the user’s personal use.
Ehaggler reserve the right to suspend, restrict or terminate the user’s access to the Website or Services at any time without notice if Ehaggler have reasonable grounds to believe the user have breached any of these restrictions or if Ehaggler suspect fraudulent account activity or behaviour. This shall not limit Ehaggler’s right to take any other action against the user that we consider appropriate.
Rights granted and rights reserved
In respect of Your use of the Website, Service and its contents, Ehaggler grants no rights to the user in relation to Our intellectual property rights including, without limitation to, copyright, trademarks, logos, graphics, photographs, animations, videos and text or the intellectual property of third parties in the Website and its contents.
The user may not copy, reproduce, republish, download, post, broadcast, record, transmit, commercially exploit, edit, communicate to the public or distribute in any way the Services, Web pages or materials on the Website or the computer codes of elements comprising the Website other than for the users own personal use.
Any use other than that permitted under this clause may only be undertaken with Our prior express authorisation.
Bidding
Users are permitted to bid by means of single bids or the Bid Butler feature. Once a bid has been placed, it is deducted from the user’s account and cannot be refunded. The use of Bid Butler permits users to bid on auctions even whilst they are not present. They function as per parameters specified by the user. Users are prohibited from using alternate bidding software and doing so will result in immediate disqualification.
A user can win 2 auctions in a 14 day rolling period. They will not be able to place bids on new products until this period has passed. Users will not be permitted to continue bidding on products they placed bids on before crossing the 2 auction limit. Bids placed before crossing the 2 auction limit will not be refunded.
Please note that bids bought or received due to any special offers and bids won from Ehaggler auctions will have a value of £0 and as such no money can or will be refunded.
How Ehaggler auctions function
Each bid placed, resets the time remaining for an auction by increments of 10 seconds, 30 seconds, 1 minute or 2 minutes. The increment is dependent on how long the auction has been running for or type of product on offer. The auction will end if no new bids are placed before the timer reaches zero.
Bids are only placed once they have been entered into Ehaggler’s system as opposed to when they were sent. This usually takes about a second. Ehaggler will not be held responsible for technical errors causing the placing of your bid to be delayed. This includes, but is not limited to; faulty user equipment, technical errors caused by an ISP and high volumes of internet traffic.
Ehaggler maintains the right to suspend auctions, revise bidding time of ongoing or future auctions and re-open closed auctions upon suspicions of any misdeeds.
In future Ehaggler may include a ‘Buy it Now’ feature and if we do the following will apply: If the user opts to use the "Buy it Now" feature, they will not be permitted to continue bidding on the auction. Any Bid Butler placed on that auction will be cancelled, and bids will be returned to the user’s account. The auction winner will also not be permitted to use the ‘Buy it Now’ feature. If the user fails to pay for the product within 24 hours of selecting the "Buy it Now" option, Ehaggler reserves the right to withdraw the purchase contract, and the user will not be entitled to a refund on the bids they have placed on that product. Note that when a user elects to use this feature, it will not affect the auction for other users.
The "Buy it Now" feature will be limited to 2 auctions in a period of 30 days.
Purchasing bids and products
Bid packages need to be purchased before bidding on products. Bid packages are non-refundable and it is the user's responsibility to ensure that they do not purchase more bids than they intend to use. Upon completion of purchase, bids are directly deposited into the user's account.
Bids and products can be purchased using a Visa, Visa Electron, MasterCard or Maestro card via our secure payment partner; Paypal. The user can also use their Paypal account balance if sufficient funds allow. Ehaggler reserves the right to halt delivery of a product if the user does not complete the payment. Ehaggler will not accept responsibility for technical problems caused by the supplier of the payment facility.
Once an auction has ended, the winner has 7 days to pay for the product plus any shipping and/or any vat element that may need to be added. If the user fails to do so, they lose their right to buy the product. Ehaggler will deliver the product within 30 days of receiving full payment. Due to seasonal issues any products won after the date of 1st November each year may or can take up to 10 weeks for delivery. Products will be sent to the shipping address provided by the user and always as quickly as possible.
Unless otherwise mentioned, products come with the manufacturer's warranty as supplied by them.
Ehaggler does not accept any responsibility for potential third party issues that may interfere with your account transactions. Should a transaction problem be suspected, you are compelled to inform Ehaggler right away.
In the event that Ehaggler is unable to deliver a product due to the product being out of stock, having a too long delivery time or other reasons Ehaggler will transfer monetary compensation, equivalent to the product retail price, to the user.
Customer Service
Ehaggler offers an email customer service system and all customers who send email to info@ehaggler.co.uk will automatically receive reference numbers. This number confirms that the email has been received and will be attended to by our support staff. Please note that ehaggler.co.uk is not liable for unattended requests for customers who have lost their reference numbers.
Returns Policy
All sales are final, however in some cases, Ehaggler grants winners the right to cancel an order on most auction items, (unless stated). This begins from the moment the user completes payment for a product. If the user chooses to return a product, they are entitled to a refund of the auction end price they have paid, even if the goods are not defective in any way. These cancellation rights end 14 days after the day on which a winner received the goods. Products which have been used or are unsealed are not eligible for return or refund. Please note that bid packages also cannot be returned. Exceptions apply to products which are damaged or not as described. Damaged goods should be reported within 14 days of receipt to info@ehaggler.co.uk. The cost of postage for returned products will be incurred by the user, unless goods were faulty upon receipt.
Ehaggler may at some future date permit the exchange of won products for bids equivalent to the retail value of the product they have won, up to 2 times in a calendar month. Users who opt to receive bids will not be charged the final product price or delivery charges. The value of each bid will be in accordance to the value of bid packages (rounding upward).
You have 14 days to cancel the purchase of bids and credits. If you wish to cancel your purchase of the bids or the credits, simply send us an email within 14 days from the date of purchase and we will readily refund the full purchase price.
However, do take careful notice that you may not claim a refund for a bid package you have used. By policy, refund claims for completely or partially used bid packages are invalidated immediately.
We offer a 30-day return policy to all users who purchase any Ehaggler promotional offers. Refunds are approved only if no bids or credits have been used. A cancellation fee of £25.00 applies to all refunds.
Disruptions in service
Occasionally there may be service disruptions that are beyond Ehaggler’s control. In such cases, ongoing auctions will be temporarily suspended and the highest bid will remain as before. Auctions will resume once technical errors have been resolved. Ehaggler reserves the right to change the date or time of an auction’s close should unplanned disruptions occur. Users bidding on temporarily suspended auctions will not be entitled to a refund for bids. Any disruption in service caused by a third party is beyond Ehaggler’s control and as such Ehaggler cannot nor will not be responsible for this or offer any compensation of any bid loss occurred, unless it so chooses to.
Responsible Bidding Awareness Statement
Online bidding and/or purchasing activities are becoming increasingly popular as they become recognised as a fun and exciting way of purchasing. Sites similar to Ehaggler are becoming an ever growing alternative to other forms of auction that are currently available on the Internet. Even though Ehaggler has set the price of purchasing Bids at a very low rate, in comparison to many other sites, to help in some way to mitigate the possible loss to the user, it is our intention that Ehaggler pre-purchase bidding auctions are used by the user in a responsible way and we take our responsibility towards helping our customers to have a positive experience seriously.
At Ehaggler we understand that there is risk, albeit remote, that taking part in one of the offered auctions can lead to personal and social distress if, for example, excessive time being spent on the site, and reducing time left to be spent with family and friends. In this regard, Ehaggler assumes its responsibility to provide relevant information to ensure that the offered auctions contribute to the customer’s experience in a positive way.
All users are advised to please take time to observe the following guidelines:
1. Take regular breaks between bidding and buying activities.
2. Decide a monthly budget in advance as your own personal limit. Do not increase the maximum limit which you have decided for yourself later on.
3. Before you start participating in any product auction or purchase, decide the number of bids you are willing to place or determine a price at which you will not raise the bid further.
4. Never participate under the influence of alcohol or medication, or if you are in a depressive mood.
5. Bid only when you are fully rested.
Remember you are not guaranteed to win so study and learn first!
